Under American Passport Questions
Question:
I need a good immigration lawyer in Dallas area for this case. Please only respond if you know of a good lawyer that can help us.
My husband and I have been married for 5 years this July. He came to this country illegally from mexico (no visa of any kind). We already know all the paper work that needs to be filled out and the normal process that we have to take. The only problem is I am not sure which lawyer to trust. I am putting our future in this guys hands and would like to have some peace of mind that everything will turn out okay. Also, he will need to apply for a hardship once in mexico for the interviews since I don’t make enough money to support myself without him and will have to rack up quite some debt to live while he is gone. We have been saving money to do all of this and now I need a lawyer before the prices go up and it takes even longer.
Also if anyone has done their papers recently and applied for the hardship… how long until y!
ou came back
Answer:
I dont know about Dallas but i live in NewJersey and i know of Catholic Charities…its sort of a non profit that helps people out with cheap but good legal help regardless of income.
Me and my husband were looking for a good immigration lawyer even though our case was not complicated but we could not find anybody charging less than $3000 and so someone told us to try the Catholic Charities and they charged us $1050 and within 6 months all our issues were resolved. They were very helpful and are either real attorneys or have some form of accredition that allows them to handle immigration cases.
Don’t know anyone in Dallas personally, but your lawyer does not necessarily have to be in Dallas to handle the case. Carl Shusterman is very good, but located in LA.
Are you a US citizen or permanent resident?
You and your husband are both illegals. ” I don’t make enough money to support myself without him” He is not supposed to make money because he is an illegal. He steals jobs.

Question:
Can some1 help me find a consultant or immigration service provider for h1b visa USA in India?
Answer:
H1 Visas were filed in March and the quota is already filled ( started on Apr and was done in 2 hours, there were 65,000 visas).
If you want to process a H1 Visa, you need to wait till next year as the quota for this year is done.
You need to be a professional with atleast 2 years of real-time experiance and a graduation( atleast) degree for a chance to get a visa.
You will either have to contact your firm( where you are working, if they have any offshore projects or any on-site training and developement, to send you there). The next option is getting in touch with a employeer who can find a suitable job for you, get done with the technical interview and get a offer letter. This is for a software professional, I presume that you are in software industry.
You have a lot of employeers in India who have there projects in India!
and USA, so get in touch with these employeers( or say consultant’s ).

Under Green Card Questions
Question:
I am working in a tenure track math position at a decent university and i am from India, so retrogression dates do matter a lot! I know I am not “outstanding” in any way as a researcher, but the legal definitions might vary, cause I guess you need to prety strong to get hired at a decent univ for tenure track. My question is, under which category EB-1 or EB-2 do most tenure track professors apply for green card?
Answer:
EB-1.
And the rest has been answered by first answerer. I suggest you EB-1 because you are from India, which has the longest wait period for EB2 and EB3. Contact an immigration lawyer, they will be able to help you because for EB-1 you do not need Labor Certification (it is call PERM now). But I know you need to submit certain evidence to prove that you are qualify for EB-1.
I assume you are on a work visa legally in the US? You need to approach your employer who would then apply to sponsor you for the green card, you can not just go ahead and do it yourself - you need a sponsor. Your employer would know what to do. Remember you employer may refuse to sponsor you for a green card due to the cost of what is involved in getting a green card. On that point you could suggest paying for the green card yourself if they sponsor you. But unless it is written into your contract or offered at time of employment was given they are in no way liable to obtain and sponsor you for a green!

Question:
I wanted to know if anyone has the “Cobra XRS-9930″ Radar Detector, and how effective or ineffective it is? - I see that it’s on the lower price range compared to “Escort Passport 8500 X50,” but wanted to see if it’s worth getting the Cobra insted of the Escort one?
Answer:
you could get the most expensive radar detector and still be caught, but if the cops are stupid enough to leave there radar on there pretty good
I have the 9930. I have never had a problem. I love it but the digital compass sucks so I turn it off. A buddy of mine has an Escort and he said its just a little more fancy but performs about the same.
I know you’re looking for info on the Cobra - but I thought I’d chime in on the Passport. I dont know if you have any info on it - but it works great - if you learn to work it.
When you’re in a city - you’ll get annoied quick with all the beeps from such things as Chevron, Safeways, police stations, etc. You will learn such places around the city where it will just go off, and you will become accustomed to not even registering the sound as a potential alarm.
Since I have had the Passport (4 years now) it still works just as good as the day i bought it. I believe I payed $300 for it. I have recieved 2 tickets - both of which could have been avoided to a certain extent. The Passport will sound when a police car is approaching in oncoming traffic. The way that the barricades in the road were and the time of night - I thought the cop was approaching in oncoming traffic when he was indeed parked behind an onramp clocking oncoming traffic. The second ticket I received when I breached the top of the hill and a cop was standing outside his car with the radar gun individually shooting the speeding cars. He must not have shot any cars within the half mile it took me to get to him because when he shot it at me - it made a louder sound than I have ever heard before! I do reccomend the Passport - this is the kind of product that is the perfect example of “you get what you pay for.”

Question:
Post office lost my U.S. passport application with my US Citizenship Certificate, what can I do?
The State Department has no record of ever receiving my application, my major concern is that I sent in my original US citizenship certificate and all the money paid. Now the Post Office wants me to pay $5.00 to put a trace on my money order for the State Depart, they should pay because they are the ones who lost my file.
Answer:
The P.O. is not going to pay the $5 so best to just pay it and get on with finding your paper work unless you want to forget about the passport. Just the way it is. You could be fighting with the P.O. forever
You have no idea who lost the file. It may have never arrived. It could be in a dead letter office at the post office or it could be lost at the state department. Put the trace on the package and stop trying to fight them over $5. You aren’t going to win.
Pay the $5.00 and hope they find it.
My son paid for his US passport back in 1994.It was his first one as an adult so he had to send in his birth certificate too.
I was with him and witnessed it all going into the hands of the US post Office in Rio Rancho,NM.Well, they lost everything, he never recieved his passport or birth certificate.
We filed a complaint and he got another passport good for only 6 months.I still don’t know who is using his paperwork.

Under Employment Based Green Card Questions
Question:
Answer:
Generally there is absolutely no reason why you can not have “two horses ” in the green card race. However, since you currently have residency (even if it is conditional), USCIS would reject any new green card application. Accordingly, although you may qualify as a nurse, since you already have residency you are precluded from filing another application.
What you need to do now is start documenting. You need to gather copies of all of your joint documentation (the same thing you presented at your adjustment interview) and keep them in a safe place. You will need them when you apply to remove the conditional status.
Now for the good news….
Don’t let your wife threaten you. Even if you get divorced, you can still apply for removal of conditions on your residency and request a waiver of the marital requirement. Since you are already a legal resident (albeit conditional), your wife cannot revoke your status. The only thing !
she could do would be to say the marriage was a sham, but that would just land her in jail for 5 years with a $250,000 fine.
My advice would be to go on living your life as you have been. If your marriage becomes problematic, don’t become overly concerned. You can still get your full 10-year green card.

Question:
Ive been in the us a year from uk married a us girl just got a work permit awaiting immigration to become a c?
can i go to university here even tho im awaiting citizenship
Answer:
yeah, you can go to university without being a citizen.
It will take you 7 years to become a citizen. Regardless of what happens next (green card, student visa…) you have to live here for seven years before you are eligible to become a citizen.
Since you just got your work permit, the next step is to apply for a green card. You can apply for this right after you are married. Usually the paperwork and interviews will take up to a year. Quicker with an attorney. Next, you have to wait for your green card to be processed. This could take 6 months/year depending on your local office.
It should be easy though because you are from the UK. We went through this with my hubby - he was from India. It was just a big hassle…so much paperwork…and our INS agent was a real nasty woman…

Under Immigration Questions
Question:
I am begging for some help here. I will explain everything at this time: I am a born- US citizen. I am wanting to marry this girl who is from Canada. Last week, she sent in her papers to get her passport, because apparently that is needed is we’re to get married and live in the US. Now that she’s done that, what should we be doing next? We really want to get married Jan. 2008, but is that possible… how long does the immigration process usually take? If somebody could please help me with this, I would greatly appreciate it. I’ll even pay you if neccesary, because I am desperate for some good answers.
Answer:
Ask her to come to the US and marry you here
then you must hire a good immigration attorney who will file her green card thru you and i think it will take about 1 yr for the whole thing
File for a fiance visa. It shouldn’t take long if you have a lawyer do it for you
I’m an american citizen and also i’m married to a mexican girl, been married 6.5 years now, she has to live in mexico city and i live and work in america so i can send her the money to live on, we have waited to have kids until this is over, we have put our whole life on hold to do things the correct way, this will never be over because of who we are dealing with, don’t go into this thinking everythings going to go fine because your only kidding your self, spend your money on a very aggressive lawyer your going to need one. i haven’t seen my wife in two years now are you willing to deal with that, remember a really bad
go to the website uscis.gov, then click under “Immigration forms,” scroll down until you see “Petition for Alien
Fiance(e).” read about it and download all documents you need to sponsor your soon to be wife to become a citizen. follow directions and send off to INS. if you need more assistant, i suggest you see an immigration lawyer..but if you think you can do this yourself, then do this as directed

Question:
Previously I travelled to Europe on a colombian passport. I needed a visa to be able to do that. Now I have an US passport and I would like to travel to the same countries in Europe on that passport. Will those countries see that I previously travelled on a Colombian passport and will they do difficult about that??
Answer:
That’s no problem at all. If for any change at all, it will be more convenient and easier than with a Columbian passport. Enjoy your trip.
You will not have any problems now that you have a US passport. Have fun and you can stay up to three months
no, you should legally be able to go to europe with a US passport even if youve already been with there with a different passport because with the US passport you are indicating that you are a US citizen and that should not stop you at all from going to europe.
im originally from equador, i remember long time i ago i use to have the equadorean passport, but in the last 8 years since when my parents became us citizens i got my US passport and even though its written “place of birth: Equador” i can go to europe whenever i want to. (im currently studying in italy).
so like i said, whenever i go back and forth from florence to los angeles, for xmas or summer, they never give me problems, they never even ask for my student visa, nothing. so dont worry about it at all.

Question:
We paid extra for it to arrive by June 14 (i’m leaving June 20) but they made a mistake and sent it to our house instead of the passport offices, so there’s gonna be like a delay. I’ve already bought the tickets and I really need to get the passport in time! Is there a number I can call to make sure my passport will arrive on time?
Answer:
Do you mean the passport office sent your new passport to your home address instead of somewhere else? If yes, and the passport is at home, you need to find a way to get it. Either have someone mail it to you or go home and collect it yourself.
If your passport is still in the hands of the passport agency you need to make contact with them to have it sent to you. Calling the phone numbers will likely be an exercise in frustration, so ask your US Representative (Congressman) for help in communicating with the passport agency. Call the office of your Representative TODAY to get the process started - you have les!
s than 10 days to get your passpot
Call your congressman… believe me it helps!YOUR SOL unless you know a senator or congressman personally.
